Hosted by Representative Paul Novotny, the purpose of this meeting is to discuss unfortunate business practices that impact homeowners in a home owners association. We will also  talk about best practices and what needs to happen in order to put protections in place for homeowners.

There are many myths and misconceptions around belonging to a HOA, but the bottom line is that there are no regulatory mechanisms available to protect homeowners from unfortunate business practices. For example, owners are often told to “read the bylaws” but bylaws are not a legally binding contract and current Minnesota law doesn’t require the board to abide by them if they choose not to. Current Minnesota law also allows an association to force an owner into foreclosure without a legally justifiable reason or a court action, and management companies are not required to be licensed.
